ALL EYES ARE SET AT THE APEX COURT.

 enyans are glued to their television sets and others on their smart phones and desktop computers following the Supreme Court proceedings. If you move from one ridge to the other , one village to the other , one market to the other , one shopping centre to the other , in the makeshift vibandas and kiosks , the conversation has drastically changed from Azimio la Umoja and Kenya Kwanza Alliance to the heavy legal terms and complex lingual jargons being traded at the apex courts. The social media too is awash with misinformation, disinformation and Propaganda as both camps , Azimio la Umoja and Kenya Kwanza Alliance are pulling strings to themselves. That's why , innuendos and half baked truths are the fodder of the day in this Zuckerberg streets. They say a battle isn't won in the battle field but in the boardroom. And if you lose it , it is not accidental , it is a manifestation that, you have been winning. Losing and winning is a process just like an election is a process and not an event.

The Supreme Court is expected to give guidance and the way forward. We cannot anticipate this Country to go the Somalia way , or thr Sudan way or the DRC route. That's why, the peace and tranquility we are enjoying as a Country as we speak , shows , Kenyans and politicial elites have trust and confidence in our Supreme Court. Both parties , the petitioners and respondents must commit to maintain peace irregardless of the kind of ruling the court will make. If it favours Kenya Kwanza Alliance, that is , it uphelds president elect William Ruto victory , the petitioner must accept and move on. If the Court rules of a recount and it is found that the petitioner's victory was robbed through electoral malpractices geared towards ensuring Ruto wins , and it is found Raila Odinga won , this will followed by revocation of Ruto's victory and his Certificate and gazette notice published by the IEBC chair declaring Ruto as president elect quashed , then Ruto should accept. Of the Supreme Court nullifies the whole presidential election and orders a fresh one and what would have informed that decision is because of many illegalities and irregularities and total breach of electoral rules and regulations , how if the Supreme Court can order for a repeat presidential election , which commission can hold it now that IEBC can no longer be in existence? 

The question occupying hectares of space in kenyans mind is that because, we expect the only commission that can be tasked to conduct that election is IEBC. Similarly , the SCoK can bar chairman Wafula Chebukati to conduct the repeat election. That means , the vice chairperson Juliana Cherera can step in and hold the chairperson seat on an interim basis and the commission can have the quorum to conduct that repeat presidential election. Much is expected from the apex court. The 7 judges are the citizens of this Country and they reside in it since , as judicial officers , they work from Monday to Friday. In 2017 , the SCoK nullified the presidential election amid protests from Jubilee Party supporters who went gaga and took to the social media to profile judges who nullified President Uhuru Kenyatta victory. Only two Judges dissented with the decision to nullify that victory. The infuriated President Uhuru Kenyatta whose victory was quashed rebuked those judges and even vowed to revisit that issue. Though he participated in the repeat presidential election , his main rival chickened out citing lack of trust in the electoral Commission and especially the chairman Wafula Chebukati.

Kenya is a democracy , a paragon of virtue and a beacon of fledging democratic ideals in South of Sahara and North of River Limpopo. When you take a comparative analysis on democratic ideals in the east Africa region let alone the who Africa , you will realize out democracy is maturing. Today , the whole Nation is calm. There are no tensions in all the regions unlike back in 2017. It is in this point that , Supreme Court must pronounce itself in this matter not only for today but to the future generations. It is a constitutional requirement that we conduct general elections in every 5 years. So, if we don't manage to create judicial precedents on the conduct of elections in this Country , 2027 , it may be worse and can easily plung this Country into civil war. An election is an emotive and rational exercise. That's why , each political camp is trying to whip emotions of their supporters their sides and castigating the other camp. We must have trust in Institutions we put in place as stipulated by our constitution. A constitution is not a catalyst for development but it is Development itself. Even in Authoritarian regimes , when as a Country you have a compromised judiciary which is arm twisted by both the executive and the legislature , then , there is no Country. That's a pariah State and civil disobedience, injustice , anarchy and lawlessness can be the order of the day. 

During the Kenya's dark days when the KANU regime was unleashing its iron fist on Kenyans , judiciary was a have of processing corruption and not justice. It was highly compromised and infiltrated by the executive. Infact , to put it in a better perspective , it was an appendage of the executive. Political witch hunt and trump up charges were graced by the judiciary. President Moi and his fellow cronies were using the judiciary to settle political score on their opponents. When the late President Mwai Kibaki took over instruments of power in December, 2002 , the first assignment he did is to clean our Judiciary. Many judges were sacked and the corrupt ones resigned before facing the chopping board. Since then , out judiciary have become independent thanks to the 2010 constitution. Infact, Judiciary has now become the people's watchdog on Economic, social , cultural and social issues affecting Kenyans everyday. It is stepping in where legislature has failed terribly and am not expecting the 13 Parliament to be different from the previous one. But Kenyans are very positive in our Judiciary. The many laws it has flagged down as being unconstitutional are many and all of them , may be affecting lives of Kenyans in one way or the other.

The Supreme Court is here with us. The presidential petition is before it for a second time. Will it nullify this presidential election again? Or will it upheld it? This are the things we are waiting to see.  It is a serious exercise before it since,we have a delegation of observers from Commonwealth who are in the Court Room to follow the proceedings. It is a good precedent we are setting , you lose an election and you aren't satisfied and feel that there were irregularities and illegalities , instead of going in the streets to demand justice , the court is the only best route to lodge the complaints especially in a democratic Nation. From where am seated , I have a lot of faith in our Judiciary. I know it will pronounce itself with alot of wisdom and justice.
