WILL GOVERNOR MWANGAZA SEE LIGHT OR WILL WALK IN THE DARKNESS?

 It is now clear that the impeached Meru County Governor Kawira Mwangaza will face the Senate but this time round in a committee and not the plenary. Yesterday, a majority of senators agreed to investigate and prosecute Meru County affairs which were taken in that house by the MCAs of Meru County Assembly after impeaching their Governor in an overwhelming manner. Out of 67 MCAs , both elected and nominated, only 2 didn't agree with them. It is cognizance to note , Senate doesn't impeach a Governor. Infact, they don't have such powers. What they will do after going through the evidence brought before them , they will ventilate on it and critically collate it with a mammoth of accusations levelled against the Governor. If the mover of the impeachment motion against the Governor will solidly prosecuting his case and nail the government, then ,the 11 member committee will unanimously vote to send Governor Mwangaza home or untie the noose on her neck.

Also it is good to remember that , Meru County residents have collected the required signatures to petition President Ruto through the Senate to dissolve the Meru County Goverment. It is interesting to see how this 13th Senate will hold this matter. Yesterday, Kakamega senator Dr Bonny Khalwale, the bull fighter to be the chair of that 11 member committee. During the 11th parliament , Khalwale chaired the committee which was looking at the impeachment of the then MÅ«rang'a County Governor Mwangi Wairia. I believe with the experience he has , he will apply Solomonic wisdom in this matter. The accusations levelled against Mwangaza are serious in as far as matters governance are concerned. From usurpation of the County Goverment act , public order and ethics act, public finance and management act etc to the violation of chapter 6 of the constitution on leadership and integrity , Mwangaza is on the spot too for undermining the MCAs, bullying and inciting the public to demonstrate outside the County Assembly. All this accusations this MCAs raised, what they should know even before this select committee starts its sittings is that , he who alleges must proof. 



Proofing an a case of this magnitude is the most herculean task. This select committee will act as a quasi judicial. Its verdict can only be challenged in High Court. An impeachment motion is a political process but to ascertain its constitutionality and legality, legal parameters must be put in place. That's why , going the committee way in addressing this impeachment issue of Meru County was the best route. The plenary one is the most dangerous one. It turns a blind eye on legal issues and embrace wholly the political eye. That's what happened during the impeachment of former Wajir , Nairobi and Kiambu Governors. This  three were subjected to a plenary and their cases were prosecuted in a political manner. In short, they were Politically lynched and even before that session started , their fate was determined. I don't mean that the select committee cannot too use the political route and lynch the governor or the MCAs, all what we are expecting as Kenyans and the residents of Meru County are pregnant with is justice will be delivered.

Governor Mwangaza has been maintaining that , male chauvinism and narcissism has played a big role in her political tribulations with the MCAs. There those in that county who believes that , a woman should not be occupying that senior political seat. Meru County is part of the GEMA nation. For a very long time, through their Nchuri Ncheke elders and rules , they don't give matriarchal space. They are deeply entrenched in patriarchy. The only seat they believe should be occupied by a woman is that of Women Rep. Any other is a preserve of men. That's what Governor is asserting and maintains is the genesis of his woes. Though he decided to play the Shakespearean Romeo and Juliet romance in the County Goverment affairs instead of doing it in her marital home , the MCAs took offensive with her. Her guitar loving husband Murega Baichu has caused alot of consternation and discomfiture on the MCAs who believe, he is overstepping his mandate. This is serious and Kawira Mwangaza failed to draw a line between her official roles as a Governor and romance. The guitar has also contributed to her political misfortunes as a Governor. Her ruled is now covered with a huge blanket of darkness. Instead of her Mwangaza to illuminate for her , the Mwangaza has been swallowed by the huge darkness.

Opinion is divided in Meru County as there is a section of the residents who want the Senate to save her from the hangmen and there are those who want the Senate to tighten the noose and the hangmen to execute their roles with utmost precision. Now , just like king Solomon who was confronted by the two prostitutes who were fighting for the ownership of the child , the Senate has found itself in this situation. I hope against hope that justice will be met. The law of natural justice will be applied fully and Mwangaza may see the light and her accusers see the darkness or her accusers may see the light and her Mwangaza to walk through in the darkness. The residents out there too wants either, Kawira to be acquitted or sent home or the President to dissolve the entire county government. Time will tell.
